Who is responsible for your data

What data I collect

  • Contact forms: name, email, phone (optional), due date, type of session, where you plan to give birth and your message.

  • Newsletter: your email address, only if you sign up.

  • Clients: the data needed to prepare and carry out your session, invoicing details, and the photographs and films I create.

  • Browsing: cookies, as explained in the cookie banner.

Why, and on what legal basis

  • To answer your enquiry: your request and steps prior to a contract (GDPR Art. 6.1.a and 6.1.b).

  • To carry out the services you book: performance of a contract (Art. 6.1.b).

  • To meet tax and accounting obligations: legal obligation (Art. 6.1.c).

  • To send the newsletter: your consent, which you can withdraw at any time (Art. 6.1.a).

  • Birth images can reveal health information, so I treat them as special category data and only process them with your explicit consent (Art. 9.2.a). Nothing is published on the website or social media without your written consent, image by image.

How long I keep it

Enquiries that do not lead to a booking: up to 12 months. Client data and invoices: for as long as tax law requires. Galleries and original files: as agreed in your contract. Newsletter: until you unsubscribe.

Who I share it with

I never sell your data. I use service providers that process data on my behalf, such as Squarespace (website and forms), Google (email), my online gallery provider and my accountant. Some of them may store data outside the EU, with the safeguards required by the GDPR, such as Standard Contractual Clauses or the EU–US Data Privacy Framework.

Your rights

You can request access to, correction or deletion of your data, ask me to restrict or stop processing it, ask for a copy to take elsewhere, and withdraw your consent at any time, by writing to hello@barcelonabirthphotography.com. If you are not satisfied with my reply, you can complain to the Spanish Data Protection Agency (www.aepd.es).

Qué datos recojo

  • Formularios de contacto: nombre, correo electrónico, teléfono (opcional), fecha prevista de parto, tipo de sesión, dónde piensas dar a luz y tu mensaje.

  • Newsletter: tu correo electrónico, solo si te suscribes.

  • Clientes: los datos necesarios para preparar y realizar tu sesión, los datos de facturación y las fotografías y vídeos que creo.

  • Navegación: cookies, según se explica en el aviso de cookies.

Para qué y con qué base legal

  • Responder a tu consulta: tu solicitud y la aplicación de medidas precontractuales (art. 6.1.a y 6.1.b RGPD).

  • Prestar los servicios que reserves: ejecución de un contrato (art. 6.1.b).

  • Cumplir las obligaciones fiscales y contables: obligación legal (art. 6.1.c).

  • Enviar la newsletter: tu consentimiento, que puedes retirar en cualquier momento (art. 6.1.a).

  • Las imágenes de un parto pueden revelar información de salud, por lo que las trato como categoría especial de datos y solo con tu consentimiento explícito (art. 9.2.a). Nada se publica en la web ni en redes sociales sin tu consentimiento por escrito, imagen por imagen.

Cuánto tiempo los conservo

Consultas que no terminan en reserva: hasta 12 meses. Datos de clientes y facturas: el tiempo que exija la normativa fiscal. Galerías y archivos originales: lo acordado en tu contrato. Newsletter: hasta que te des de baja.

Con quién los comparto

Nunca vendo tus datos. Trabajo con proveedores que los tratan en mi nombre, como Squarespace (web y formularios), Google (correo electrónico), mi proveedor de galerías online y mi gestoría. Algunos pueden almacenar datos fuera de la UE con las garantías que exige el RGPD, como las cláusulas contractuales tipo o el Marco de Privacidad de Datos UE–EE. UU.

Tus derechos

Puedes solicitar el acceso, la rectificación o la supresión de tus datos, la limitación u oposición a su tratamiento y su portabilidad, y retirar tu consentimiento en cualquier momento, escribiendo a hello@barcelonabirthphotography.com. Si no estás conforme con mi respuesta, puedes presentar una reclamación ante la Agencia Española de Protección de Datos (www.aepd.es).
